Yes, motoring legal expenses cover almost always earns its premium: €47.88 to €89.88 a year in the grids consulted, against lawyer's fees that reach €1,089 incl. VAT for a first recovery claim. Contracts differ on the minimum dispute threshold, the ceiling and the waiting period, not on price. Three figures to compare before signing, and one calculation to tell whether the add-on pays off for you.
Six contracts, six lines: the price says almost nothing
The base premium varies by a factor of three between the cheapest and the dearest contract, but the clauses that decide reimbursement vary far more. Here is what Belgian insurers and specialists publish, as of 01/10/2026.

Two caveats. The specialists' prices are base prices; the source does not detail the surcharge for a vehicle. And the Ethias leaflet describes an all-purpose product, not a strictly motoring add-on. The site's reference profile (35 years old, Golf 1.5 TSI, Flemish Brabant, no claims for five years) does not change these amounts in any published way: the source varies the price by the number of insured vehicles, not by the driver's profile.
How much does a motoring dispute cost someone who is not insured?
Between €1,089 and €30,250 incl. VAT depending on severity, on the basis of a median hourly rate that I set as a calculation assumption. Belgian lawyers charge €80 to €480 an hour, and 21% VAT is added to fees.

How to read the last column: with a €47.88 premium, the first scenario pays off as soon as one driver in 23 faces it in a given year. With €89.88, one in 12.
Fees are not everything. A court-appointed expert's costs come on top, and the procedural indemnity the loser pays the winner only covers a flat fraction of these costs. I have not quantified it here: it depends on the amount at stake and it is indexed.
At what probability of a dispute does the premium pay off?
As soon as you have more than a one-in-a-hundred chance each year of going to police court, legal expenses cover pays for itself. For a simple recovery claim, you need a one-in-twelve to one-in-twenty-three chance.
Nobody knows their personal probability, and that is where the trade-off becomes honest. A motorist who drives 15,000 km a year in Flemish Brabant mostly faces a low-frequency, high-severity risk: a third party contesting his share of liability, an insurance expert undervaluing the damage. Exactly the risk profile insurance exists to handle.
A small claim does not justify activating the contract. Our analysis of reporting a claim or paying out of pocket shows that an at-fault claim costs €280 from the first year on the reference profile; legal expenses cover changes nothing there.
Five clauses weigh more than the premium
Before comparing two contracts on a €20 difference, read these lines in this order.
- The minimum dispute threshold. Below €500 at stake at Ethias, the insurer pays nothing. A broken headlight at €380 is not covered, and it would not be worth arguing anyway: a registered letter does the job.
- The deductible. Ethias keeps €250 per dispute, unless you accept mediation. On the simple recovery claim at €1,089, you get back €839.
- The ceiling per cover. It ranges from €20,000 (Federale) to €125,000 (Arces) for the same type of dispute.
- The waiting period. From 0 to 24 months depending on the cover and the insurer. A dispute that has already arisen is excluded.
- The exclusions. Federale rules out fines and criminal proceedings costs; that is standard, but check it line by line.
The ceiling only bites after 100 hours of lawyer time
In the last scenario, bodily injury with a court-appointed expert at €30,250 incl. VAT, the ceiling becomes decisive: with €20,000 at Federale, €10,250 stays with you. With €30,000 at Ethias, €250 stays, plus the possible deductible. With €100,000 at ARAG Bronze or €125,000 at Arces, the bill is covered.
In the first three scenarios, no ceiling of €20,000 or more is reached. That surprises people: most drivers compare ceilings of €20,000 and €125,000 when the typical dispute never gets near either. The ceiling protects against the worst case, it does not alone justify rejecting a cheap contract.
Car policy add-on or standalone contract: which one?
A specialist's standalone contract (DAS, ARAG, Arces) beats the add-on in two cases: when the dispute pits the policyholder against his own car insurer, and when the add-on's ceiling is low. In other cases the add-on is enough.
The first case comes down to a conflict of interest that our article on optional cover details: the legal defence included in liability cover is paid by the insurer that compensates the other party. A separate contract, run by a separate company, removes that tension.
The add-on has an administrative advantage: one contact, one renewal notice. It loses out if its ceiling drops to €20,000 and its waiting period is not published.
Is a €380 dispute covered?
At Ethias, no: the threshold is €500. At Arces, yes if the cover sets its threshold at €200 or less. The calculation is unfavourable anyway: €380 of damage against €1,089 of fees for a simple recovery claim. The right strategy is a written formal notice, then the complaints department of the other party's insurer.
